
The Bombay High Court has set aside arbitral awards that held Sharekhan liable for investor losses in Futures Options trading. The court ruled that a broker's failure to maintain SEBI-mandated trade confirmations does not automatically make them liable for speculative trading losses if investors delegated trades silently and incurred risks. The ruling noted that investors must own risks associated with trades executed by their trusted persons, even if procedural lapses occurred.
