
The Delhi High Court has ruled that a wife's earning capacity cannot be presumed at the interim maintenance stage without prima facie evidence. Justice Swarana Kanta Sharma stated that a husband's unsubstantiated claims of his wife working are insufficient. The court noted the wife's limited education and enhanced her interim maintenance from Rs 2,500 to Rs 3,500 per month, directing the husband to pay arrears. The case involves a couple married in 2021, with the wife alleging dowry-related cruelty and abandonment.
