
Six years after a 2019 amendment to the Arbitration Act, India has yet to constitute the Arbitration Council of India, hindering its potential as an international arbitration hub. Former Union law secretary P K Malhotra stated that the absence of this institutional mechanism promotes problematic ad-hoc arbitration, leading some government departments to opt for mediation. Law Minister Arjun Ram Meghwal has expressed hope for India to become an arbitration hub, following recommendations from an expert committee. However, proposed amendments to the law have faced delays.
