The Supreme Court has issued notices to the Centre and state governments regarding a Public Interest Litigation (PIL) seeking the implementation of the 'creamy layer' principle in Scheduled Caste (SC) and Scheduled Tribe (ST) reservations. Advocate Ashwini Kumar Upadhyay argued that affluent families within these communities disproportionately benefit, defeating the purpose of affirmative action. The PIL contends that individuals from SC/ST families who have attained senior positions should not receive reservation benefits, as it excludes the most marginalized. The court has tagged this plea with a pending petition concerning priority reservation for economically weaker sections.
