
The Madras High Court has criticized preventive detention laws as "draconian" and contrary to fundamental rights. Hearing a habeas corpus petition, the court granted 12 weeks interim bail to a YouTube investigative journalist detained under the Tamil Nadu Prevention of Dangerous Activities Act. Justices S M Subramaniam and P Dhanabal emphasized that personal liberty is a constitutional right, not a state concession, and that failure to protect it renders state actions unconstitutional.
