
The Supreme Court has issued a notice to the Centre and the Election Commission of India (ECI) regarding a Public Interest Litigation (PIL) challenging Section 16 of the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023. The NGO Lok Prahari argues that the law grants unprecedented lifelong immunity from civil and criminal proceedings to the CEC and ECs for actions taken in their official capacity, which they claim is unconstitutional. The court agreed to examine the provision but refused to grant a stay.
