Experts suggest the amendment, particularly Section 1A, may be legally challenged as ultra vires because it impacts RERA, a Central Act, and was allegedly not referred to the President for approval as required by Article 254 of the Constitution. This amendment could potentially allow promoters facing prosecution for offenses against homebuyers to avoid penalties.
