The mandatory probate of wills has been removed in Mumbai, Chennai, and Kolkata following an amendment to the Indian Succession Act, 1925. This change, part of the Repealing and Amending Act, 2025, means heirs in these cities can now claim property directly from a will without court confirmation, making the process faster and cheaper. The government cited the colonial-era provision as discriminatory and unequal. Probate remains mandatory in other Indian cities and is still required if a will is disputed.
