The court dismissed a petition by New India Assurance, upholding consumer forum orders to honor a claim from the 2005 Mumbai deluge. The insurer had attempted to repudiate the claim, citing a dishonored cheque, but the court found operational lapses by the company, not the policyholder, were responsible for the issue.
