
The Bombay High Court upheld a Rs 1.3 crore compensation award for a road accident victim's mother, rejecting the insurance company's argument that the victim's failure to wear a helmet contributed to the accident. Justice M S Sonak noted the insurance company did not raise the helmet issue in its written statement and lacked corroborative evidence. The court found that the helmet would not have altered the outcome of the collision, which involved a car overtaking on the wrong side of the road.
