Karnataka HC Releases Two Nigerians Over Arrest Procedure, Orders Deportation for Visa Overstay

The Karnataka High Court ordered the release of two Nigerian nationals arrested in 2024 for alleged drug peddling, citing police failure to inform them of arrest grounds as required under Article 22 of the Constitution. The court emphasized that Article 22 protections apply to all persons in India, not just citizens. However, it directed the Foreigners Regional Registration Office to deport the individuals for overstaying without valid visas for over a decade. The court also mandated the formation of screening committees to monitor and address visa overstays.
