
The Supreme Court has ruled that the mere apprehension of a detenu engaging in crime if granted bail is insufficient grounds for preventive detention. A bench of Justices J K Maheshwari and A S Chandurkar set aside a detention order against a Hyderabad woman accused of drug offenses. The court emphasized that the detaining authority must demonstrate how public order was or would be adversely affected, distinguishing this from ordinary law and order concerns. The Telangana High Court's prior dismissal of the detention challenge was also overturned.
