
The Bombay High Court recently set aside a Nashik family court's divorce decree granted on grounds of cruelty based solely on WhatsApp chats. The bench of Justices Bharati Dangre and Manjusha Deshpande ruled that the wife was not given an opportunity to rebut the digital evidence, which the family court had relied on to find cruelty. The High Court emphasized that divorce cannot be granted without proper evidence and a fair hearing, remanding the case for fresh consideration and suggesting mediation between the parties.
