
The Allahabad High Court has upheld an order setting aside the removal of a CISF head constable. The court ruled that mere incarceration in a criminal case, without a conviction, is not sufficient grounds for dismissal from service. While acknowledging that incarceration might warrant suspension, the bench stated that initiating disciplinary proceedings and issuing a chargesheet solely based on imprisonment is not permissible. The constable was removed after being charged with gross misconduct due to his alleged involvement in a murder case, for which he was incarcerated for four months before obtaining bail.
