
Since its introduction in September, only about 70 employers have paid the $100,000 fee imposed on certain H-1B visa hires from outside the US, according to a government lawyer in a federal court hearing. Plaintiffs, including small businesses, argue the fee restricts access to the H-1B program, while the government contends the low payment rate shows it is not a revenue-raising tax requiring congressional approval. The court is reviewing legal challenges amid recent Supreme Court rulings on presidential tariff powers.
