
The Delhi High Court can now examine the constitutional validity of sections 6 and 7 of the Special Marriage Act, 1954, concerning mandatory public notices for marriages. The Supreme Court dismissed a government petition seeking to transfer a related challenge from the Delhi High Court to itself. An interfaith couple's petition, pending since 2020, argued that the notice period infringes privacy and can be used to obstruct interfaith marriages, potentially forcing couples to convert or marry in religious ceremonies.
