The tribunal found the original Employment Tribunal's reasoning on disability discrimination under the Equality Act 2010 inadequate, requiring a fresh assessment of whether her condition substantially affects daily activities. Pal also challenged Accenture's 'up or out' promotion model as unfair under the Employment Rights Act 1996. The case will return to a new tribunal for reconsideration.
